API Terms of Use

By accessing or using the Edvak API (“API”), you (the “Developer”) agree to comply with these Terms of Use. These terms govern your use of the API and outline permitted practices and responsibilities.

1. License and Access#

Edvak grants you a non-exclusive, non-transferable license to use the API solely for developing applications that interact with Edvak’s services, including accessing USCDI-aligned patient data via secure endpoints.

2. Usage Guidelines#

Use the API only for authorized and approved purposes.
Do not exceed acceptable usage thresholds; Edvak may apply rate limits or restrict access to ensure system stability.
API keys or credentials must not be shared or embedded in public repositories.

3. Authentication & Security#

All requests to the API require valid credentials and tokens as documented in the API Reference Guide.
You are responsible for maintaining the confidentiality and security of your API credentials.

4. Data Handling & Compliance#

You agree to:
Access and use only the data you are authorized to handle.
Comply with HIPAA and other relevant data privacy laws.
Use appropriate safeguards to protect any Personal Health Information (PHI).
If acting on behalf of a covered entity, sign a Business Associate Agreement (BAA) if required.

5. Availability & Changes#

The API is offered as-is and may be updated, deprecated, or temporarily unavailable due to maintenance.
Any significant changes will be announced in advance via official communication channels or developer documentation.

6. Restrictions#

You agree NOT to:
Reverse engineer or tamper with the API.
Use the API for unlawful, harmful, or unauthorized purposes.
Store PHI or credentials in an insecure manner.

7. Intellectual Property#

All rights and ownership of the API, associated tools, and documentation remain with Edvak. These terms do not grant you ownership or distribution rights.

8. Termination#

Edvak reserves the right to revoke your API access at any time for reasons including—but not limited to—violations of these Terms, system abuse, or suspected security breaches.

10. Permitted Use of EHI (ONC Cures Update Compliance)#

These Terms of Use do not impose any restrictions on the access, exchange, or use of electronic health information (EHI) as defined under 45 CFR §170.315(g)(10), except as necessary to:
Ensure compliance with applicable laws and regulations;
Protect the security and integrity of the API and underlying systems;
Prevent misuse or unauthorized access.

11. Disclaimer & Limitation of Liability#

The API is provided “as is” without warranties of any kind. Edvak disclaims all liability for any direct or indirect damages resulting from API usage.
By using the Edvak API, you acknowledge that you have read, understood, and agreed to these Terms of Use.
